Details of the Transvaginal Mesh Lawsuit
In July of 2012, a California woman was awarded $5.5 million as a mesh lawsuit settlement from a case filed against one of the manufacturers of transvaginal mesh implants used in the treatment of stress urinary incontinence and pelvic organ prolapse. For this California woman, she had the mesh surgery in order to correct bladder leakage during running. In this mesh law suit, the woman claimed that the manufacturer knew that its mesh device was unsafe, yet continued to market it nonetheless. This transvaginal mesh lawsuit was filed against C. R. Bard regarding its Avaulta device. Other mesh claims have been filed against Johnson & Johnson's Ethicon, Boston Scientific, and American Medical Systems.
Mesh Lawsuit Settlement Details
The injuries that come from transvaginal mesh do not only affect the woman treated with the device, but also her family as well. Of the California mesh lawsuit settlement, the woman was awarded a $5 million settlement because she claimed that she had experienced tremendous pain and suffering. In addition the defective mesh eroded. Mesh erosion is also called extrusion, exposure, and protrusion) occurs when the mesh device is not compatible with the surrounding tissues and forcibly pushes through them. Signs of mesh erosion include harsh vaginal/pelvic pain, heightened discomfort during sexual intercourse, and even an inability to have intercourse. At the time of the case, she had undergone eight corrective mesh erosion or mesh revision surgeries and will still require more. After her initial mesh surgery, the device cut into her colon. Mesh devices have also been reported to perforate other organs including: bladder, bowel, and blood vessels. In this mesh lawsuit settlement, the husband of the woman was also awarded $500,000 because of the damage that the vaginal mesh caused to their love life. This is typically referred to as a "loss of consortium."
Mesh Lawsuit Settlement Update
In addition to this California transvaginal mesh lawsuit, other victims of vaginal mesh injuries around the country are seeking settlements in other cases. At present there is both state level and multidistrict litigation pending against Johnson & Johnson's Ethicon division for its role in marketing and manufacturing mesh products as well.
